Section 504 Plans for Students with Disabilities

Section 504 of the Rehabilitation Act is a federal law that protects qualified students with disabilities from disability-based discrimination by schools that receive federal funding, including private schools.

Section 504 requires that covered schools provide academic, nonacademic, and extracurricular services to protected students with disabilities in the same settings as students without disabilities, to the maximum extent appropriate to their needs. It also requires that public schools provide qualified students with a free appropriate public education (“FAPE”) and that private schools that receive federal funding provide qualified students with an appropriate education. FAPE includes an obligation to provide aids, services, and accommodations to students with disabilities.
